1. Acceptance of Terms

2. Scope of Services
Naqsh Digital specializes in bespoke high-speed web application development, custom UI/UX design, Shopify integrations, search engine optimization (SEO), Google Business Profile (GMB) optimization, and Meta/Google Paid PPC advertising. Detailed project deliverables, technical frameworks, timelines, and budgets are governed individually by formal Statement of Work (SOW) agreements.
3. Payments, Billing & Milestones
Payments for customized software engineering or digital marketing consulting must align strictly with SOW billing milestones. Late payments or failure to provide essential project credentials (such as API keys, content assets, or DNS configuration parameters) may result in temporary suspension of project operations and adjustments to targeted release dates.
4. Intellectual Property
All website source code, visual design schemes, custom copywriting, graphical assets, brand elements, and underlying technical structures hosted on this domain are the exclusive property of Naqsh Digital or our licensed providers. Upon complete settlement of all SOW milestones and associated invoices, the custom software, source files, and configured marketing assets developed specifically for a client will transition ownership to that client, subject to standard licensing parameters.
5. Prohibited Activities
As a visitor or client, you agree not to engage in any activity that compromises the safety, speed, or integrity of our digital platforms. Prohibited activities include, but are not limited to:
- Attempting to bypass server security, inject malicious scripts, or run automated denial-of-service tests.
- Scraping content, intellectual descriptions, or portfolio lists without express written authorization.
- Impersonating Naqsh Digital engineers or using our corporate credentials to communicate with outside entities.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Naqsh Digital, its officers, engineers, and partners will not be liable for any indirect, incidental, special, exemplary, or consequential damages (including lost profits, server downtimes, business interruptions, or data losses) arising from your use of this website, third-party platform updates (such as Google core algorithm updates, Shopify changes, or Meta ads policy updates), or services provided.
7. Dispute Resolution & Governing Law
These Terms and any individual project agreements (SOWs) are governed and interpreted in accordance with the laws of India and the UAE, without regard to conflict of law principles. Any legal disputes, mediation sessions, or actions arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in Delhi, India or Dubai, UAE.
